Terms of Service
Effective Date: July 1,2026
These Terms of Service (“Terms”) govern all heating, ventilation, air conditioning, indoor air quality, and related services provided by DS Comfort Air (“Company”). By scheduling or accepting service, the customer agrees to these Terms.
1. Estimates
All estimates are provided in good faith based on the information available at the time of inspection. Hidden conditions or unforeseen issues may require additional repairs or charges. Any additional work will be discussed with the customer before proceeding whenever possible.
2. Payment Terms
Payment is due upon completion of service unless other arrangements have been made in writing.
Accepted forms of payment include:
- Cash
- Check
- Credit or Debit Card
- Approved Financing (when available)
- Invoices not paid by the due date may be subject to late fees and collection costs permitted by law.
3. Scheduling and Appointments
Customers are responsible for providing safe access to the equipment during the scheduled appointment.
If an appointment must be canceled or rescheduled, we request at least 24 hours’ notice whenever possible.
4. Diagnostic Fees
Diagnostic fees cover the technician’s travel, inspection, testing, and evaluation of the HVAC system. Diagnostic fees are non-refundable, regardless of whether repairs are approved.
5. Repairs
Repair recommendations are based on the condition of the equipment at the time of inspection.
While every effort is made to restore equipment to proper operation, the Company cannot guarantee that additional failures will not occur due to the age or condition of the system.
6. Replacement Parts
Manufacturer warranties apply only to eligible replacement parts.
Labor warranties are provided according to the terms stated on the invoice or proposal.
Warranty coverage may be void if:
- Equipment is altered by others.
- Repairs are performed by unauthorized persons.
- Equipment is misused, neglected, or improperly maintained.
7. Maintenance Services
Maintenance visits are preventive in nature and are designed to improve equipment reliability and efficiency.
Maintenance does not guarantee that equipment will not fail or require future repairs.
8. Customer Responsibilities
The customer agrees to:
- Provide safe and unobstructed access to all equipment.
- Secure pets before technician arrival.
- Notify the Company of known hazards.
- Maintain electrical service and utilities during service.
9. Safety
Our technicians reserve the right to refuse service if unsafe conditions exist, including but not limited to:
- Unsafe electrical conditions
- Gas leaks
- Structural hazards
- Aggressive animals
- Threatening behavior
10. Existing Equipment
The Company is not responsible for failures caused by:
- Age of equipment
- Rust or corrosion
- Existing defects
- Improper installation by others
- Pre-existing refrigerant leaks
- Power surges or utility interruptions
11. Refrigerant
Any refrigerant added during service will be billed separately unless otherwise stated.
If a refrigerant leak is suspected, leak detection and repair may be recommended before additional refrigerant is added.
12. Permits and Code Compliance
When required, permits may be obtained for installations. Additional costs may apply.
Equipment will be installed in accordance with applicable local codes in effect at the time of installation.
13. Property Protection
Reasonable care will be taken to protect the customer’s home during service.
The customer understands that access to HVAC equipment may require movement of attic insulation, ceiling tiles, landscaping, or stored items.
14. Limitation of Liability
To the maximum extent permitted by law, DS Comfort Air shall not be liable for indirect, incidental, special, or consequential damages arising from the use of HVAC equipment or services provided.
15. Force Majeure
The Company is not responsible for delays caused by weather, supply chain shortages, utility outages, natural disasters, labor disputes, or other circumstances beyond its reasonable control.
16. Right to Refuse Service
DS Comfort Air reserves the right to refuse or discontinue service due to unsafe conditions, abusive conduct, nonpayment, or circumstances that place employees or customers at risk.
17. Governing Law
These Terms shall be governed by the laws of the State of Texas.
